INTRODUCTION

Jobloads believes that there is dignity in every job, and people can find mana at work when the conditions are tika/right. The company is building the first online 2-sided marketplace that connects vulnerable horticulture workers with growers.

We comply with the New Zealand Privacy Act 2020 (the Act) when dealing with personal information. Personal information is information about an identifiable individual (a natural person).

This policy sets out how we will collect, use, disclose and protect your personal information. The use of this website is subject to our Terms of Use, Acceptable Use Policy and this Privacy Policy.

By providing us with your personal information, you agree to the collection, use, disclosure and storage of your personal information in accordance with this Privacy Policy. If you do not agree, you may not be able to use the Services.

This policy does not limit or exclude any of your rights under the Act. If you wish to seek further information on the Act, see www.privacy.org.nz.

CHANGES TO THIS POLICY

We may change this policy by uploading a revised policy onto the website. The change will apply from the date that we upload the revised policy.

DEFINITIONS

In this policy:

Employer means a company or business that uses the Jobloads platform to post Job Listings, hire Jobstars, and manage their employment relationship with Jobstars.

Job Listing means a listing made by an Employer on the Jobloads platform seeking labour services from Jobstars.

Jobloads, we, us or our means Jobloads Limited, 21 Derby Street, Gisborne, company number 7455097.

Jobstar means an individual that offers their labour services through the Jobloads platform.

CHILD SAFETY

The Jobloads platform is intended for use only by persons who are at least 16 years of age. If you believe we have collected personal information from or about a child under the age of 16, please contact us at kiaora@jobloads.co.nz.

HOW DO WE COLLECT PERSONAL INFORMATION

Directly from you

We collect the following information directly from you:

  • when you fill in a contact or enquiry form on our website, call us, meet us in person or otherwise contact us, your name, email address, phone number and any other information you choose to provide to us

  • when you sign up to our newsletter and other electronic alerts relating to Jobloads, your name, email address and any other information you provide to us when you ask to receive our newsletter or other alerts

  • when you register for, or login to, an account on Jobloads, your name, email address and any other information we require or ask for to set you up with an account or that you submit to us for billing or payment purposes. See below for further details of the information collected.

Some personal information that we collect directly from you may be mandatory and some may be optional. We will let you know which of these applies at the time we collect the relevant personal information. While you do not have to provide us with some information we may request, this might mean that our website or Jobloads may not perform as well as they should, or that we may not be able to provide some parts of our website or Jobloads to you. Automatically when you use our website or Jobloads

When you access and use our website or Jobloads we may automatically collect information about your device and usage of our website and Jobloads, including your IP address, operating system, browser type, time spent on certain pages of the website, pages visited and links clicked.

Some of this data is collected through third party tools and/or the use of cookies, web beacons, embedded web links and similar storage technologies. You may disable cookies by changing the settings on your browser, although this may mean that you cannot use all of the features of the website, the Jobloads platform or our other services.

We use your personal information only for purposes you have agreed to, for purposes related to the provision of our services (as detailed below) or where we are authorised, or required to under the Act or any other law.

APPLYING TO BECOME A VERIFIED JOBSTAR

If you wish to use the Jobloads platform to find and apply for jobs, you must first complete our screening process to become a verified Jobstar.

We may collect the following personal information when you register to become a verified Jobstar:

  • full name

  • gender

  • contact phone number

  • email address

  • date of birth

  • right to work in New Zealand

  • passport

  • birth certificate

  • drivers’ licence qualifications/certifications

  • IR330 form

  • Kiwisaver form

  • Home address

  • Visa information

  • IRD number

We use this information:

  • to verify your identity

  • to register you as a Jobstar on the Jobloads platform

  • to create a user profile

  • to identify you when you sign in to your account and to verify your account is not being used by anyone else

  • to provide Jobloads to you

  • to market our services and products to you, including contacting you electronically (e.g. by text or email for this purpose)

  • to improve Jobloads

  • to respond to communications from you, including a complaint

  • to conduct research and statistical analysis (on an anonymised basis)

  • to protect and/or enforce our legal rights and interests, including defending any claim

  • to ensure we are billing Employers accurately;

  • for any other purpose authorised by you or the Act.

We may disclose your passport, birth certificate or drivers’ licence details to an identity verification service for the purpose of verifying your identity. Except as set out in the General Disclosure section

below, we will not otherwise disclose your passport, birth certificate or drivers’ licence details.

We may contact you using the email address you provide to us to verify your account and for administration purposes, such as account management or customer service.

REGISTERING AS AN EMPLOYER

If you register with the Jobloads platform as an Employer, we may collect the following personal information:

  • full name

  • gender

  • contact phone number

  • email address

  • job role

  • company details

  • location

  • IRD number and MYIR number

  • industry

  • payroll provider.

We use this information:

  • to register you as an Employer on the Jobloads platform

  • to create a user profile

  • to send you applications from Jobstars

  • to identify you when you sign in to your account and to verify your account is not being used by anyone else

  • to provide Jobloads to you

  • to market our services and products to you, including contacting you electronically (e.g. by text or email for this purpose)

  • to improve Jobloads

  • to undertake credit checks of you (if necessary)

  • to bill you and to collect money that you owe us, including authorising and processing credit card transactions

  • to respond to communications from you, including a complaint

  • to conduct research and statistical analysis (on an anonymised basis)

  • to protect and/or enforce our legal rights and interests, including defending any claim

  • for any other purpose authorised by you or the Act.

USER PROFILE

If you are a Jobstar and we have successfully verified your identity, you can create a user profile. Information that you can choose to provide includes:

  • full name

  • city/region

  • education level

  • qualifications/certifications

  • photo of yourself

  • bio about yourself

  • goals

  • past work experience

  • any other information about yourself

We may also show a badge against your profile to indicate whether your identity has been verified.

Your profile will also include your email address and phone number. Other Jobloads users will not be able to see these details unless you choose to make these details available.

Employers can also create a user profile. Information that Employers can choose to provide includes:

  • contact person

  • company details

  • location

  • industry

  • bio

  • profile photos

  • site photos

  • feedback from Jobstars

  • multiple site locations

  • map of site

The user profile information provided by Jobstars and Employers will be visible to other Jobloads users. You can, at any time, amend, correct or remove information on your profile by signing into your account and editing your profile.

JOB LISTINGS

When an Employer posts a Job Listing, we may collect the following information:

  • job description

  • location

  • pay rate

  • additional terms and conditions of the job.

We may use this information:

  • to provide the Jobloads platform to our users

  • to bill and to collect money from Employers

  • to respond to communications, including a complaint

  • to conduct research and statistical analysis (on an anonymised basis)

  • to protect and/or enforce our legal rights and interests, including defending any claim

  • for any other purpose authorised by you or the Act.

JOBS

When you apply for a job through a Job Listing, we will disclose your name and photo to the potential Employer, so that the Employer can identify you and contact you in relation to the job. The Employer will also be able to see your user profile. Any questions relating to a Job Listing advertised on the Jobloads platform, your online application and/or the status of your application should be directed to the Employer, not us. The use of your information by Employers is not within our control and we cannot accept responsibility for the conduct of Employers. We suggest you ask the potential Employers for their privacy policy for further information about how the Employer may use, disclose, store and process your personal information.

FEEDBACK

Jobstars are able to provide feedback about Employers (e.g. about site and working conditions), and Employers are able to provide feedback about Jobstars (e.g. about performance on a job), via the Jobloads platform.

Feedback about you provided by other users is intended to be public for the benefit of other Jobloads users and will be displayed on your profile.

You must notify us of any error or inaccurate statement in feedback provided by you.

TIMESHEETS

Employers use timesheets for record-keeping purposes (e.g. to track hours worked by Jobstars). We may use this information for billing purposes, to calculate the applicable service fees to charge Employers for their use of the Jobloads platform.

ANALYTICAL DATA

We collect non-identifiable personal information when:

  • users input information into the Jobloads platform

  • users access and use our website, the Jobloads platform or our other services.

We may use this information:

  • to conduct statistical analysis and identify trends and insights

  • for research and development purposes.

GENERAL DISCLOSURE

In addition to the disclosure purposes set out above, we may disclose personal information to:

  • any business that supports our services and products, including any person that hosts or maintains any underlying IT systems or data centre that we use to provide Jobloads or our website

  • a credit reference agency for the purpose of credit checking an Employer

  • other third parties (for anonymised statistical information)

  • a person who can require us to supply personal information (e.g. a regulatory authority)

  • any other person authorised by the Act or another law (e.g. a law enforcement agency)

  • any other person authorised by the individual concerned.

A business that supports our services and products may be located outside New Zealand. This may mean personal information is held and processed outside New Zealand.

PROTECTING PERSONAL INFORMATION

As required by the Act, we will take reasonable steps to keep personal information safe from loss, unauthorised activity, or other misuse. We implement appropriate technical and organisational measures to ensure a level of security appropriate to risks inherent in processing personal information.

If you are a user of the Jobloads platform or our other services, you can play an important role in keeping personal information secure by maintaining the confidentiality of any password and accounts used in relation to the Jobloads platform or our other services. Please do not disclose your password to third parties. Please notify us immediately if there is any unauthorised use of your account or any other breach of security.

ACCESSING AND CORRECTING PERSONAL INFORMATION

Subject to certain grounds for refusal set out in the Act, you have the right to access readily retrievable personal information that we hold about you and to request a correction to your personal information.

If you believe we hold personal information about you and want to exercise either of the above rights, email us at kiaora@jobloads.co.nz. We will need evidence to confirm that you are the individual to whom the personal information relates. Your email should provide evidence of who you are and set out the details of your request (e.g. the personal information, or the correction, that you are requesting). In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.

Some of the information that is held in the Jobloads platform is held by us as a service provider and as agent for the relevant Employer. If we receive any requests to access or correct personal information held in the Jobloads platform as agent for an Employer, we will forward this request to the relevant Employer, unless we are prohibited to do so by law.

INTERNET USE

While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk. If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal information. We suggest you review that site’s privacy policy before you provide personal information.

DATA RETENTION POLICY

The personal information that we collect and use will not be kept longer than necessary for the purposes for which it is collected, or for the duration required for compliance with applicable law, whichever is longer.
